Absence of Pemberton’s fingerprint, DNA samples hurting Laudes’ case – lawyer

(MNS photo) MANILA (Mabuhay) – The continued absence of US Marine Private First Class Joseph Scott Pemberton has started to baffle the family of Jeffrey “Jennifer” Laude, the transgender whom he allegedly murdered in Olongapo City last October 11. Pemberton should be made to appear even to just accommodate the Laudes’ request for fingerprint and DNA samples to be used as bases for comparison, said the family’s counsel Harry Roque. “I don’t understand why, in my 25 years of practicing criminal law, this is the only case where there are no fingerprints [of the suspect],” said Roque at a forum at the University of the Philippines Law Center Tuesday. “There is no basis for comparison of the semen specimen and fingerprints found at the scene of the crime, and the VFA is the reason why we don’t have that evidence,” he said. VFA is the Visiting Forces Agreement, which contains a provision that allows US custody of of its erring personnel  until the end of all judicial proceedings. VFA didn’t kill Jennifer Laude – DFA

(MNS photo) MANILA (Mabuhay) – Amid calls for the abrogation of the Visiting Forces Agreement (VFA), the Department of Foreign Affairs (DFA) maintained that the accord has served the “national interest” of the country. “I think the VFA has served the national interest [of the Philippines]. It doesn’t follow that VFA killed Jennifer Laude,” DFA spokesman Charles Jose said. Jose said that if not because of the VFA, the country would not have criminal jurisdiction over US Private First Class Joseph Scott Pemberton, the suspect in the brutal killing of transgender Jeffrey “Jennifer” Laude. Laude was found lifeless inside the bathroom of a motel in Olongapo City on October 11. “If there is no VFA, he (Pemberton) might have a total immunity. But because of the VFA, we are able to investigate him,” he said, adding that the Philippine government has Pemeberton’s criminal jurisdiction. According to Jose, Pemberton, who is now detained at the joint Philippine-American facility in Camp Aguinaldo, could not leave the country while the investigation is ongoing. Although Pemberton has failed to appear and submit a statement at his preliminary investigation set on October 21 and 27, Jose said his lawyer’s appearance in court was an indication that they were willing to be subjected to an investigation. HONG KONG (AFP) – Filipino boxing star Manny Pacquiao said he hoped to finally step in the ring with arch-rival Floyd Mayweather next year as he denied he was taking his upcoming opponent Chris Algieri lightly. Pacquiao, mobbed by his supporters during a promotional trip to Hong Kong, said “I’m crossing my fingers” that the hotly anticipated Mayweather fight could happen in 2015. “Hopefully that fight will happen by next year,” he told AFP in an interview. “I’m crossing my fingers that that fight will happen but right now my mind is already set to focus on my next fight with Algieri. I think the time to talk about that issue is after the fight.” The eyes of the boxing world have long been on a showdown between the unbeaten American and eight-division world champion Pacquiao (56-5-2), two of the greatest boxers of their generation. Jolina Magdangal (MNS photo) It’s official: One of the most popular love teams of the ‘90s returns as Marvin Agustin and Jolina Magdangal are back with ABS-CBN as the lead stars of a drama series. On Monday, Magdangal reported to her first shooting day for “Flordeliza,” confirming weeks of speculation that she will reunite with Agustin nearly two decades after they were launched as a tandem via “Gimik” in 1996. Agustin earlier announced in his return to ABS-CBN with the lead role in “Flordeliza,” but could not confirm if Magdangal had officially signed up as his leading lady in the project. The new series is under the direction of Wenn Deramas, who was also behind Magdangal and Agustin’s last film together as ABS-CBN stars, “Kung Ikaw Ay Isang Panaginip,” in 2002. Magdangal transferred to GMA-7 that year. Agustin followed suit in 2006. Without giving details about her role in “Flordeliza,” Magdangal said she has never done a similar character in her career. Derek Ramsay, estranged wife finally settle dispute

Derek Ramsay (MNS photo) TV5 actor Derek Ramsay and his legal wife, Filipino-Indian model Mary Christine Jolly, have finally settled their dispute, a Makati City judge announced on Twitter. Judge Eugene Paras of Makati Regional Trial Court Branch 58 posted a photo of himself flanked by the estranged couple with the caption “They finally settled [smiley]“. On Saturday Paras confirmed the news to an entertainment news site but clarified that he did not preside over the settlement. However, he said Ramsay and Jolly had indeed officially buried the hatchet “in one of the family courts of Makati” around 2PM on Friday. Paras noted that the details of the compromise agreement are “private and confidential”. Neither party has issued a statement since Friday, although both Ramsay and Jolly sought media coverage of their previous court appearances. In July, Jolly sued Ramsay for violation of Republic Act 9262 (Violence Against Women and Their Children), declaring that they had married in civil rites in Balagtas, Bulacan on April 3, 2002. They reportedly separated five months later but the brief union bore a son, Austin Gabriel Ramsay, now 11. In his counter-affidavit filed the following month, Ramsay admitted the wedding but claimed that he had been under the impression that the marriage was “invalid”. Saying they are doing their best to repent and live a life of good, the inmates wrote a letter dated September 26 to the pope via Apostolic Nuncio Giuseppe Pinto. “We hope and pray that as you continue God’s mission of loving all His children and inspiring them, you will give us a few minutes of your most precious time during your visit here in January 2015,” they said. Pope Francis is to visit the Philippines on Jan. 15 to 19 next year. “At this point, we know that it is impossible to happen, but we are still taking our chance of inviting you our beloved Father, to please visit us here in prisons. Cold weather threatens Benguet flower growers’ produce for Undas

(MNS Photo ) MANILA (Mabuhay) – The cold weather plus the damage to greenhouses caused by recent cyclones now threatens the produce of flower growers in Benguet for the coming Undas (All Saints’ and All Souls’ Days). Flower growers said the cold weather has caused leaves of Malaysian Mums to dry, and there are no greenhouses to protect them. “Nabutas ‘yung greenhouse. Hindi siguro nila napansin. Tulad niyan may tulo-tulo doon,” said agriculturist Miguel Bagtila. Also, flower growers said they expect a smaller harvest as the greenhouses were damaged by Typhoon Luis and Tropical Storm Mario. Flower grower Marvin Sabela said the cold had also affected the growth of roses. Last September, Mario caused some P100,000 in damage to a greenhouse in La Trinidad in Benguet, destroying the flowers the owner had planned to sell for Undas. The municipal agriculture office estimated some 600 flower growers were affected by Mario. The Benguet Flower Association said Mario had a large effect on their industry. (MNS)
