Ng: Scientific breakthroughs

THIS week, I would like to cover some exciting technology developments that would potentially impact us. Science and technology have progressed fast. Last week, Time showed that a baby may live up to 142 years, while Businessweek was more audacious. It showed a woman who may live to be 173. As science progresses, we are able to lead longer (and hopefully, more productive) lives. A person in the Philippines expects to reach an average of 70 (in some countries, it is nearer 80), which is 20 years more than the norm about 70 years ago. More than a third of Japan’s population is now over 60, while in the United States, there are more people over 60 than there are people under 15. This does not hold true in the Philippines. We are one of few countries with a very young population, which is why many economnists are saying our economy will surely grow – it’s called the demographic advantage. The search for the fountain of youth has spanned thousands of years, from the first Chinese emperor who was looking for the elixir, to the famed European expeditions around the world looking for it all over the Americas. It might actually be in our generation that the stuff of science fiction comes true. A few years ago, GlaxoSmithLine reportedly paid $720 million to buy Sirtris Pharmaceuticals, which believed they found a compound they called resveratrol. In 2008, sales reached more than $100 million a year. But things did not work Read More …

Petron Sprint 4T Motorcycle Oils are designed to meet the unique performance requirements of four-stroke motorcycles. Unlike passenger cars, motorcycle engines require lower oil volume, have higher power output, and operate at higher engine speeds. However, Bugante said she still does not have the information as to where these branches and service office will be set up. Oro Chamber gears up for Asean Integration

THE Cagayan de Oro Chamber of Commerce (Oro Chamber) is gearing up for the challenges in the upcoming Association of Southeast Asian Nations (Asean) integration through Asean Economic Community (AEC) this year. With AEC on, Oro Chamber expects new investors arriving in the city to take advantage of the market. The Asean integration is aimed at improving the standard of living and quality of life of the people in the region. Cerael Donggay, president of Oro Chamber, said that they are expecting much from this integration. “Our role, with the upcoming Asean Regional Integration, is to help our members – industries, sectors, commercial establishments, trade and commerce, services, etc. survive the [upcoming integration] competition… so we should find ways for them to survive,” Donggay said. Donggay added that they are now in the “planning stage” on how to make local businesses and entrepreneurs compete and collaborate with foreign investors. He said that one example in helping local businesses is for Oro Chamber to promote more industries to come in and put up their business here and generate employment through vertical integration – upstream and downstream. He added that as part of the AEC, inclusive growth should be achieved in which there is a reduction of poverty along with increase of employment – if this happens, there is peace and order. “A country with a low economic development will create disorder – militant movement, rebellion – subversive element… we can eliminate this by ensuring that there is an inclusive growth where Read More …

Almirante: Regular Employment

Petitioner Dionarto Q. Noblejas was appointed by respondent Italian Maritime Acadamy Philippines, Inc. (IMAPI) as training instructor/assessor on a contractual basis for three months effective May 20, 2009. After the expiration of the three-month period, IMAPI hired Noblejas anew as training instructor/assessor with the same salary rate but no written contract was executed for his rehiring. In a case for illegal dismissal filed by Noblejas against IMAPI, the former claims that he already attained the status of a regular employee because he was allowed to work beyond the stipulated period of his employment and he performed functions which were necessary or desirable in the usual business or trade of IMAPI. Does his contention find merit? Ruling: Yes. Pursuant to Article 280 of the Labor Code, there are two kinds of regular employees, namely: (1) those who are engaged to perform activities that are usually necessary or desirable in the usual business or trade of the employer; and (2) those who have rendered at least one year of service, whether continuous or broken, with respect to the activities in which they are employed. Regular employees are further classified into (1) regular employees by nature of work and (2) regular employees by years of service. The former refers to those employees who perform a particular function that is necessary or desirable in the usual business or trade of the employer, regardless of their length of service; while the latter refers to those employees who have been performing the job, regardless of its Read More …

(NPI) launched Monday the company’s all-new compact truck, the 2015 Nissan NP300 Navara. It will be available in Cebu this month, according to Nissan Cebu Distributors, Inc., the only authorized local dealer. The launch at Sofitel Philippine Plaza in Manila last Feb. 2 was the first such event among 180 countries worldwide that Nissan Motor Corp. held to introduce Nissan Navara commercially outside Japan. The 2015 Navarra combines toughness with attractive design and smart interior, an innovation in response to customers demand for comfort, modern styling and attention to details on top of durability, reliability and practical performance, the company said in a press statement. “Nissan has been innovating in the compact pick-up market since 1935. This is part of our history,” said Mamoro Aoki, executive design director of Nissan Motor Corp.of Japan. The Nissan NP300 Navara has a very solid vehicle structure with wider fender and big tires. “It’s fundamentally a tough car, but its design treatment is very dynamic and modern,” said Aoki. While Nissan engineers recognized that customers today demand comfort, they realized that comfort in any condition or situation is not easy. They had to test the Navara in various terrains and road conditions to develop what is now the NP300 model, the company said. Separation pay in lieu of reinstatement

RESPONDENT Janrie C. Dailig, a security guard, was relieved from his post on Dec. 10, 2005. He filed a complaint against petitioner Emeritus Security and Maintenance Systems, Inc. for illegal dismissal, underpayment of salaries and non-payment of full back wages. The labor arbiter found respondent to have been illegally dismissed. Accordingly, petitioner was ordered to reinstate respondent and to pay him back wages from the time his compensation was withheld until actual reinstatement. The National Labor Relations Commission (NLRC) dismissed the appeal filed by petitioner for lack of merit. The NLRC, however, pointed out that the computation of respondent’s award of full back wages should be reckoned from June 10, 2006 and not Dec. 10, 2005. The Court of Appeals (CA) affirmed the finding of the labor arbiter and the NLRC that respondent was illegally dismissed by petitioner. It, however, set aside the labor arbiter and the NLRC’s reinstatement order. Instead, the CA ordered the payment of separation pay, invoking the doctrine of strained relations between the parties. Did the CA err?Ruling: Yes. In this case, petitioner claims that it complied with the reinstatement order of the Labor Arbiter. On Jan. 23, 2008, petitioner sent respondent a notice informing him of the Labor Arbiter’s decision to reinstate him. Accordingly, in February 2008, respondent was assigned by petitioner to Canlubang Sugar Estate, Inc. in Canlubang, Laguna, and to various posts thereafter. At the time of the filing of the petition, respondent was assigned by petitioner to MD Distripark Manila, Inc. in Read More …
