SC upholds tax perks of Pagcor

The Supreme Court building INQUIRER FILE PHOTO MANILA, Philippines—The Supreme Court has ordered the Bureau of Internal Revenue (BIR) to stop collecting corporate income tax from the Philippine Amusement and Gaming Corp.’s (Pagcor) operations and licensing of gambling casinos, gaming clubs and other similar recreation or amusement places, gaming pools and other related activities. In a 14-page decision released recently, the court en banc ordered the BIR to cease and desist from implementing a 2013 memorandum circular that imposed corporate income tax on Pagcor’s income derived from its gaming operations as well as franchise tax on income from other related services. The BIR issued its circular after the Supreme Court, in 2011, ruled as valid an amendment to the National Internal Revenue Code that listed several entities exempt from paying corporate income tax. The list did not include Pagcor so the BIR began assessing Pagcor for income and franchise taxes, thus prompting the state-owned company to file a motion for clarification before the high court in September 2013. In its new ruling, the high court said the amendment of the code, made though Republic Act No. 9337, did not also amend Pagcor’s charter, which provided that income from gaming operations was subject only the 5-percent franchise tax while its income from operation of other related services was subject to income tax only. The 5-percent franchise tax being collected by the BIR was not applicable to Pagcor’s income from other related services, the court’s decision, written by Justice Diosdado Peralta, stated. A report from Joint Task Group Sulu said that Hja Dingkim Yap, 58, was taken by about six unidentified armed men boarding a blue Tamaraw FX in Chinese Pier in Sulu at about 12:30 p.m. It did not say who abducted the businesswoman. The military is doing an all-out law enforcement operations against the Abu Sayyaf group, is holding several hostages in the area of Sulu, after the release of its German captives last November for a reported P250 million. Several hostages were also released in the following months. Joint follow up operations are being conducted by Jolo and Patikul police for the Chinese businesswoman, the report said. Mitsubishi expects robust sales of Strada in 2015; launch of new model set in March

MANILA, Philippines–Mitsubishi Motors Philippines Corp. (MMPC) expects to more than double the sales this year of its all new Strada pickup, which will be launched next month. MMPC vice president for marketing services Froilan Dytianquin confirmed the planned launch as parent firm, Mitsubishi Motors Corp. of Japan, had announced earlier this week the rollout of the all-new Triton pickup truck from its assembly facility in Thailand. In the Philippines, the Triton is marketed as the Strada. “(The all-new Strada) was actually introduced first in Thailand and we are the first left-hand drive market to launch it since our pick-up sales volume comes after Thailand and Indonesia,” Dytianquin said Thursday in a text message. “We are looking at selling around 7,000 units this year. Last year, we sold around 3,000 units of the Strada,” he added. In a separate statement, MMC said this model, considered one of the company’s best-selling nameplates, had been developed to be the “ultimate sport utility truck, combining comfortable interior space of a passenger car with the functionality and reliability of a pickup.” The all-new Triton went on sale in Thailand in November 2014, and MMC plans to roll out the all-new Triton starting in the Philippines, then sequentially in the Asean, Oceania, the Middle East, Europe, Africa and Latin America, and eventually will be exported to some 150 countries. Nestor Corrales/INQUIRER.net CLARK, Philippines— The 21 member economies of the Asia-Pacific Economic Cooperation (Apec) are bolstering their anti-terrorism defenses to ensure security and stability in the Asia-Pacific region. “Apec members are strengthening capacity in the Asia-Pacific region to fight terrorism and ensure the security of our people and our economies,” Oscar Valenzuela, chair of the Apec Counter-Terrorism Working group said in a statement. Valenzuela said coordination among member economies is underway as terrorism continues to elevate risks in the Asia-Pacific region. “We continue to see a rise in the spread of violent extremism worldwide,” he said. Valenzuela said the brutal death of two Japanese hostages by the Islamic State group signals an increased threat in the region. He said the new developments in technology and communications are posing new counter-terrorism challenges that put lives and livelihoods at risk, citing “it is critical to move swiftly to address these advances.” The Apec official pointed the importance of aligning government policies of member economies as well as with existing anti-money laundering and counter-terrorism regimes to clamp down the financing of terrorists. Nestor Corrales/INQUIRER.net CLARK, Philippines— The first Asia-Pacific Economic Cooperation (Apec) 2015 Senior Officials’ meeting formally kicked off Friday at the Fontana Convention Center in Clark, Pampanga. Senior officials of the 21-member economies are attending the two-day formal meeting to discuss challenges and opportunities in the Asia-Pacific region and lay down policies to achieve Apec’s goals. “Today, as Senior Officials, we shall note of all the recommendations made by the working groups as well as consider how to advance initiatives particularly those that crosscut the three Apec committees,” Laura del Rosario, Undersecreatry of the Department of Foreign Affairs said in her welcome address. Prior to the Senior Officials’ meeting, the various technical groups and committees that report to the Apec senior officials met on January 26 to discuss initiatives, policies and capacity-building that advances Apec’s objectives. The Apec Senior Officials’ Meeting runs from Jan. 26 to Feb. 7 at the Clark and Subic freeport zones. US funded SAF operations to get Marwan—source

PHOTO FROM FBI.GOV ZAMBOANGA CITY, Philippines – Inside a beachfront resort here, several Americans planned the botched Jan. 25 operations in Mamasapano, Maguindanao, which killed Malaysian terrorist Zulkifli bin Hir, alias Marwan, but also left 44 police commandos, 18 rebels and four civilians dead. A Philippine Daily Inquirer source who refused to be identified due to security reasons said the Mamasapano operation was “fully funded by the US.” “The Americans, who have a secret facility inside the La Vista del Mar Resort, planned and funded the operation,” the source said. La Vista del Mar Resort, located in Barangay (village) Upper Calarian some six kilometers from the city’s downtown area, is owned by the family of first district Rep. Celso Lobregat. Lobregat denied knowing anything about the operations to get Marwan or accommodating American operatives to plan the secret operations in his hotel. “I do not know anything about it,” Lobregat, in a text message to the Inquirer Thursday afternoon, said. The source described the “facility” inside La Vista del Mar as having a blue gate and having been “occupied by the Americans and the biggest number of elite forces of the 84th Special Action Force Company.” According to Joel New, the barangay chair of San Jose Gusu and a former employee of the resort, the facility belongs to Special Action Force (SAF). “It’s a camp of the SAF and it is located beside the resort. Norwegian, Filipina nabbed for using banned premium hardwood in resort

PUERTO PRINCESA CITY, Palawan, Philippines – Palawan’s provincial enforcement authorities on Sunday arrested and booked a Norwegian national and his Filipina partner following a raid at their resort facility in the tourist town of El Nido, which netted over P7 million worth of banned premium hardwood species. Charged with forestry law violations was Jan Nielsen, a Norwegian passport holder, and Michelle Gasacao, a local. Both were brought to Puerto Princesa City by the apprehending team on Sunday for inquest before the Provincial Fiscal’s office. The raid on the couple’s property, the El Nido Adventure Resort still under construction in Barangay (village) Corong-Corong, El Nido, on Saturday, yielded over 8,000 board feet of banned hardwood with an estimated black market value of over P7 million, according to Niño Rey Estoya, head of the Palawan Council for Sustainable Development Staff (PCSDS) Regulation and Enforcement Division. The lumber were mostly Palawan Ipil, nato and amugis species, he said. Estoya said the raid, which they conducted on the basis of an arrest warrant issued a day before the operation by Palawan’s “green court” judge Ambrosio de Luna, netted one of the largest haul of illegal logs in recent months. “We have not yet established where all those illegal logs came from but it’s likely they were all from the forests of El Nido and the adjacent towns of Taytay and Roxas,” Estoya said. Aquino: Pope Francis ‘very very happy’ with his PH visit

AP MANILA, Philippines – Pope Francis was “very very happy” with the warmth of Filipinos during his five-day visit to the Philippines, which concluded on Monday, President Benigno Aquino III said. “So tuwang-tuwa siya doon sa hospitality na ipinakita. Damang-dama daw niya yung warmth,” he said in an ambush interview with reporters after leading the send-off for Pope Francis at Villamor Air Base. “May reflection siya dito sa buong biyahe niya at talagang gaano katuwa nga daw siya — gaano sila natutuwa nga dito sa mga — yung ipinakita ng ating sambayanan. So ang sabi ko: “Kaya nga ho sa aking pananaw kong pribilehiyo mag-lingkod talaga sa sambayanang Pilipino” he added.
