Sandiganbayan orders transfer of $42-M Marcos loot to PHL gov’t

The Sandiganbayan has ordered the turnover to the Philippine government of $42 million that was found to have been part of Ferdinand Marcos’ ill-gotten wealth and seized from his estate. The anti-graft court’s Special Division issued a two-page Writ of Execution dated August 18, 2014 against all assets held by Arelma Inc. based on a ruling of the Supreme Court dated March 12, 2014. Arelma was a foundation created by the late dictator under Panamanian laws in 1972. The high tribunal’s decision in March denied with finality separate motions for reconsideration against the the asset’s forfeiture filed by former First Lady and Ilocos Norte Rep. Imelda R. Marcos, and Senator Ferdinand Marcos Jr. The court ordered acting chief judicial staff officer Albert A. dela Cruz to ensure the transfer of the entire $42 million from the Philippine National Bank, which is holding the funds in escrow, to the Bureau of Treasury . According to an entry of judgment dated March 31, 2014, the Supreme Court ruling became final and executory prompting the Presidential Commission on Good Government to petition the Sandiganbayan for a writ of execution. The PCGG filed the forfeiture petition in 1991 docketed as Civil Case No. 0141. SC gives green light to try Orient Bank owner, execs

The Supreme Court has ordered a Manila court to proceed hearing the estafa cases against the executives of Orient Commercial Banking Corporation (OCBC), including its owner, Jose Go, for alleged falsification of checks. In a ruling penned by Associate Justice Mariano del Castillo, the SC reversed a September 30, 2009 decision and a January 22, 2010 resolution of the Court of Appeals that upheld the dismissal of the cases against Go and the others that were pending before the Manila Regional Trial Court Branch 49. “For purposes of proving the crime, it has been shown that Go converted bank funds to his own personal use when they were deposited in his accounts and his personal checks were cleared and the funds were debited from his account. This suffices,” the high court said. The SC ruled that the prosecution’s reliance on supposed loan documents, subsidiary ledgers, deposit slip, cash proof, and other documents was proper. “They are both public and private documents which may be received in evidence; Notably, petitioner’s documentary evidence was admitted in full by the trial court,” it said. OCBC The OCBC was shut down on Oct. 14, 1998 and was placed in receivership by the The Philippine Deposit Insurance Corp. (PDIC). PNoy’s advisers on legislative agenda told to perform job better

Officials of the Presidential Legislative Liaison Office (PLLO) on Tuesday received a scolding from the Senate committee on finance following the huge number of bills vetoed by President Benigno Aquino III during the 15th Congress. The PLLO, an attached agency in the Palace, is tasked to promote the legislative agenda of the executive department. “Alam ninyo mahabang proseso po ang ginugugol ng both houses of Congress sa pagpapasa ng mga bill na yan, tapos in the end mave-veto lang pala,” committee member Sen. Nancy Binay said before the officials of the PLLO during the hearing of the agency’s P38.4-million proposed budget for 2015. During the hearing, PLLO Undersecretary Antonio Gallardo admitted that 78 bills were vetoed by Aquino during the 15th Congress, but was quick to add that 56 of those were just bills pertaining to road conversions. “Most of them are road conversions. They were basically vetoed because the technical descriptions were wrong,” Gallardo explained. But committee chairman Sen. Francis Escudero did not buy Gallardo’s reasoning. “This is the first time that this is happening. In the past kapag sinabi ng Palasyo na hindi namin aaprobahan yan, hindi na itutuloy ng Kongreso,” Escudero said. “And with Senator Franklin Drilon as Senate President and with Rep. Palparan wants trial before Sandiganbayan, not Bulacan RTC

Citing threats to his life, retired Major General Jovito Palparan said Sunday he will file a motion to be transferred from Bulacan Provincial Jail to a military detention facility. In a report aired on “Balitanghali”, Palparan said he will also file a petition before the Supreme Court to change of venue of his trial for kidnapping and serious illegal detention from the Bulacan Regional Trial Court to the Sandiganbayan in Quezon City. The former military official is implicated in the disappearance of of college students Sherlyn Cadapan and Karen Empeño in 2006. Palparan said his trial deserves to be held at the Sandiganbayan by virtue of his rank when the incident that became the basis for the case against him took place. “The crime that was committed happened during my time as commander of the Army 7th Infantry Division.The rank calls for a Sandiganbayan hearing,” he said. Narzal Mallares, a lawyer for Palparan, said last week that the retired general would ask the Malolos Regional Trial Court to allow him to be detained instead at the PNP Custodial Center in Camp Crame, where other high-profile detainees are being held. According to Mallares, Palparan’s life is in danger because of the reported presence of detained New People’s Army rebels at the provincial jail, where he is currently detained. Lacierda's ‘no-el’ gaffe part of ‘conscious effort’ to push term extension – UNA

Presidential spokesperson Edwin Lacierda’s remarks about a possible no-election scenario in 2016 was not a mere slip of the tongue but part of a “conscious effort” by the “Balay” faction in the Liberal Party to extend President Benigno Aquino III’s term, the United Nationalist Alliance (UNA) claimed Sunday. UNA secretary general and Navotas Rep. Toby Tiangco said the Roxas-Abad group within LP, otherwise known as the “Balay” faction, appears to be floating the idea of not holding the May 2016 presidential elections. “Yung mga gustong guluhin ang eleksyon eh yung mga nag-aambisyon sa 2016 but have no chance at all to win in an honest and clean elections. They have no chance at all that they [would] rather skirt the Constitution and acquire power illegally,” he said in a statement. Full Text: The people's initiative petition against pork barrel

Advocates for the abolition of the pork barrel system kicked off a signature campaign for a bill that they say will remove discretionary spending in government. Under the Initiative and Referendum Act, petitions need “at least ten per centum of the total number of the registered voters, of which every legislative district is represented by at least three per centum of the registered voters thereof.” The petition, if found sufficient by the Commission on Elections, will be subject to a referendum and will need to get a majority vote for approval. Church for the Poor, one of the groups supporting the initiative, has provided a copy of the petition: People’s Initiative Petition vs. Pork Barrel Deputy Presidential Spokesperson Abigail Valte, in a Palace briefing over government radio on Sunday, declined comment on the initiative but said people are free to pursue it. House panel OKs bill on appointment of military officers as DND chief

The House Committee on National Defense and Security has approved a measure prohibiting the appointment of a commissioned officer of the Armed Forces of the Philippines as Secretary of the Department of National Defense within three years after he has been separated from active duty. House Bill No. 2, authored by committee chair Muntinlupa City Rep. Rodolfo Biazon, amends Section 45 of Chapter 10 Book IV of Executive Order 292, otherwise known as the Administrative Code of 1987. The Administrative Code lists the general qualifications and limitations required of all Cabinet members, in addition to those prescribed in their respective charters. Biazon, a former AFP Chief of Staff, said the Administrative Code’s provision on the requirements for the appointment of the DND Secretary should be amended to “emphasize further the supremacy of civilian authority over the military. “By prohibiting a former military officer from being appointed within three years after relief from active duty, the position will be shielded from controversies arising from appointments, assignments, and other activities within the AFP,” he said in the bill’s explanatory note. The three-year ban on appointing  former military officers as DND Secretary will not only give them sufficient time to adapt to civilian life, but will also allow them to be “more objective and impartial in policy formulation and determination” as a result of not having prior personal and professional relationships with the [active] officers, Biazon added. Group warns vs. potential toxin in artificial nails

Girls and women getting into the artificial fingernails craze may want to think twice – the glue they use to put on the accessories may contain a potential toxin, an ecological group warned. The EcoWaste Coalition said the nail adhesive used to bond the fake nails may be dangerous to one’s health, after encountering plastic nails with no authorization from the Food and Drugs Administration in Divisoria. “The glue’s orange label includes the precautionary warning ‘keep out of reach of children,’ but the product itself is being sold in toy stores and often bought with the intent of re-selling to kids,” said coordinator Aileen Lucero. According to the group, the fingernails come in 20 small plastic packets with six to 12 decorated nails and a small tube of nail adhesive. Such products sell for P50 to P80 per set, or P2.50 to P4 per packet. The group noted the tube label lists the ingredients of the nail adhesive as acetone, carboxylated vinyl resins, hexamethylene, methyl ethyl ketone and dibutyl phthalate. EcoWaster said DBP is classified by the European Chemicals Agency as “toxic to reproduction,” and is banned in cosmetics, and child articles and toys. EU also considers DBP as “dangerous for the environment” and “very toxic to aquatic life,” the group said. Religious, students to join march vs. pork barrel on Monday

Religious groups and Catholic school students may be among those taking part in Monday’s protest actions seeking the abolition of the pork barrel system on Monday. The Association of Major Religious Superiors of the Philippines (AMRSP) said its members will join protesters demanding an end to corruption in government. “Truly, a government that is committed to a ‘tuwid na daan’ cannot co-exist with a system that is based on patronage and corruption,” the AMRSP said in an article posted on the Catholic Bishops’ Conference of the Philippines news site. It noted the protest action will be held at the Luneta in Manila from 6 a.m. to noon. In August 2013, several organizations also gathered in Luneta to condemn corruption in the government. AMRSP also demanded an impartial and speedy investigation of all parties involved in the Priority Development Assistance Fund and Disbursement Acceleration Program controversies “regardless of affiliation.” “We also demand a full accounting of all the funds related to DAP,” they said. Meanwhile, students of the University of Santo Tomas are also expected at Monday’s action. The central student government tweeted an invitation to students to join the “TOMASINO PARA SA BAYAN: UST Against Pork!” March from UST to Plaza Salamanca, Taft & Plaza Salamanca, Taft to Luneta Park.
