Petitioner Dionarto Q. Noblejas was appointed by respondent Italian Maritime Acadamy Philippines, Inc. (IMAPI) as training instructor/assessor on a contractual basis for three months effective May 20, 2009. After the expiration of the three-month period, IMAPI hired Noblejas anew as training instructor/assessor with the same salary rate but no written contract was executed for his rehiring. In a case for illegal dismissal filed by Noblejas against IMAPI, the former claims that he already attained the status of a regular employee because he was allowed to work beyond the stipulated period of his employment and he performed functions which were necessary or desirable in the usual business or trade of IMAPI. Does his contention find merit? Ruling: Yes. Pursuant to Article 280 of the Labor Code, there are two kinds of regular employees, namely: (1) those who are engaged to perform activities that are usually necessary or desirable in the usual business or trade of the employer; and (2) those who have rendered at least one year of service, whether continuous or broken, with respect to the activities in which they are employed. Regular employees are further classified into (1) regular employees by nature of work and (2) regular employees by years of service. Ompong Plaza asks Sandiganbayan to dismiss pork barrel scam raps

Former Agusan Del Sur Representative Rodolfo Plaza has asked the anti-graft court Sandiganbayan to dismiss the multiple cases filed against him in connection with his alleged involvement in the multibillion-peso pork barrel fund scam. Plaza said the cases were based on mere “hearsay”. In his 18-page “urgent motion for judicial determination of probable cause” filed with the Sandiganbayan Second Division, Plaza through his legal counsel, said the Office of the Ombudsman erred in its resolution finding probable cause to file against cases of malversation, graft and direct bribery against him. He said the charges lacked evidence apart from the testimony of pork barrel scam primary whistleblower Benhur Luy. “Movant Plaza respectfully submits that his inclusion in these cases is erroneous and that movant is implicated only in these instant cases on inadmissible evidence,” Plaza said in his motion filed on February 9 but only made available to the media on Friday. Plaza was among the second batch of lawmakers charged by the Office of the Ombudsman before the Sandiganbayan earlier this month for their alleged involvement in the pork scam. Filed against Plaza were five counts of graft, five counts of malversation and two counts of direct bribery for allegedly funnelling, from 2004 to 2010, his Priority Development Assistance Fund (PDAF) or pork barrel to fake non-government organizations (NGOs) allegedly owned by Janet Lim-Napoles in exchange for commissions or kickbacks amounting P42.1 million. Revilla lawyer formally withdraws from ‘pork’ cases

Ramon “Bong” Revilla and his lawyer Joel Bodegon have formally cut ties, according to a manifestation sent to the Sandiganbayan First Division Wednesday, but made public Thursday. In a two-page document, Bodegon, who said last week that he will stop handling Revilla’s pork barrel scam cases, informed the court that he is no longer lawyering for the senator. “Undersigned law firm respectfully withdraws as Counsel for Sen. Ramon “Bong” Revilla, Jr. in the instant case. Sen. Revilla’s conformity is indicated herein below,” the document said. Revilla is accused of funneling millions of pesos in his Priority Development Assistance Fund (PDAF) or pork barrel fund to fictitious non-government organizations for kickbacks. The said NGOs were allegedly put up by businesswoman Janet Lim-Napoles. Revilla and his co-accused allegedly received P224.5 million in kickbacks from 2006 to 2010. Ex-Benguet solon posts P530,000 bail for ‘pork’ cases

Former Benguet Rep. Samuel Dangwa has posted bail amounting to P530,000 for his temporary liberty even before the Sandiganbayan rules on whether there is probable cause to try him and order his arrest for multiple charges stemming from the pork barrel fund scam. In a chance interview, Sandiganbayan Third Division clerk of court Dennis Pulma said Dangwa posted bail on Wednesday, February 11, for his six counts of graft, six counts of malversation and five counts of direct bribery charges in connection with the alleged scam. Dangwa was among the second batch of lawmakers charged by the Office of the Ombudsman before the Sandiganbayan for their alleged involvement in the multibillion-peso pork barrel scam. The other lawmakers were former Masbate Rep. and incumbent Masbate Governor Rizalina Seachon-Lanete, former APEC party-list Rep. Edgar Valdez, former Cagayan De Oro Rep. Constantino Jaraula and former Agusan Del Sur Rep. Rodolfo Plaza. Janet Lim-Napoles, the alleged mastermind in the pork barrel scam, is co-accused in all the charges filed against the five former lawmakers. She is currently detained at the Bureau of Jail Management and Penology (BJMP) facility in Camp Bagong Diwa in Taguig. Mitsubishi expects robust sales of Strada in 2015; launch of new model set in March

MANILA, Philippines–Mitsubishi Motors Philippines Corp. (MMPC) expects to more than double the sales this year of its all new Strada pickup, which will be launched next month. MMPC vice president for marketing services Froilan Dytianquin confirmed the planned launch as parent firm, Mitsubishi Motors Corp. of Japan, had announced earlier this week the rollout of the all-new Triton pickup truck from its assembly facility in Thailand. In the Philippines, the Triton is marketed as the Strada. “(The all-new Strada) was actually introduced first in Thailand and we are the first left-hand drive market to launch it since our pick-up sales volume comes after Thailand and Indonesia,” Dytianquin said Thursday in a text message. “We are looking at selling around 7,000 units this year. Last year, we sold around 3,000 units of the Strada,” he added. In a separate statement, MMC said this model, considered one of the company’s best-selling nameplates, had been developed to be the “ultimate sport utility truck, combining comfortable interior space of a passenger car with the functionality and reliability of a pickup.” The all-new Triton went on sale in Thailand in November 2014, and MMC plans to roll out the all-new Triton starting in the Philippines, then sequentially in the Asean, Oceania, the Middle East, Europe, Africa and Latin America, and eventually will be exported to some 150 countries. Cell phone thefts down sharply in SF, NY, London due to kill switches

FILE PHOTO NEW YORK – New crime data shows that smartphone thefts and robberies have declined dramatically in New York City, London and San Francisco since the wireless industry began to implement “kill switches” on their devices. Attorney General Eric T. Schneiderman, London Mayor Boris Johnson and San Francisco District Attorney George Gascón released the data. The three co-chair the Secure Our Smartphones (SOS) Initiative, an international partnership of law-enforcement agencies, elected officials and consumer advocates formed in June 2013 to tackle the violent crime wave of smartphone thefts. The SOS Initiative called on the smartphone industry to adopt kill switch technology as a theft deterrent. The crime data released shows the effectiveness of the strategy of putting pressure on private industry to implement existing technology that removes incentives to steal a smartphone is working to reduce crime and protect wireless consumers. After SOS called on the industry to adopt a kill switch, Apple introduced Activation Lock in September 2013.  While initially an opt-in solution, there has been a steady downward trend in thefts targeting smartphones since the implementation of this technology. From January 2013 to December 2014, New York City’s Police Department recorded a 16 percent overall drop in cell phone robberies, including a 25 percent drop in iPhone robberies—the first phone to adopt a kill switch. ABS-CBN allots P600 M for shift to digital TV

MANILA, Philippines – Broadcast giant ABS-CBN Corp. is spending another P600 million to expand its digital terrestrial television (DTT) service nationwide as part of the directive of the National Telecommunications Commission (NTC) to shift to DTT broadcast over the next few years. Ronaldo Valdueza, chief financial officer of the ABS-CBN Group, said in an interview with reporters during the launch of its DTT service via the ABS-CBN TVplus Wednesday evening that the additional investment would cover its expansion to provinces including Cagayan de Oro, Bacolod, Iloilo, Davao, and Naga.  “Based on our estimate it would be around P600 million this year. We are still looking at the investment to cover nationwide. We will see how the market response first,” Valdueza said. The listed broadcast company has invested at least P3 billion for the shift to DTT from analog signal. According to Valdueza, the DTT service now covers Metro Manila, Rizal, Cavite, Laguna, Bulacan, Pampanga, Nueva Ecija, Tarlac, Pangasinan, Benguet, and Cebu but would soon be widely available in more areas as it aims to bring more digitally clear signal and a more enjoyable TV viewing experience for all Filipinos nationwide. London’s Lord Mayor in town to firm up trade ties with PH

MANILA, Philippines—A ranking government official from the United Kingdom is in the country for a two-day visit, as part of the UK’s effort to sustain economic ties with the Philippines. According to the British Embassy in Manila, the Right Honourable, the Lord Mayor of the City of London Alderman Alan Yarrow is arriving today to “strengthen UK-Philippine partnerships and promote British capabilities in the areas of public-private partnerships (PPP), and financial and professional services, as well as to promote inward investment into the UK for companies looking to expand into Europe.” The Lord Mayor is the ambassador of UK-based financial and professional services industry.
