Pemberton shows up for first time

OLONGAPO CITY—For a moment, Marilou Laude held the gaze of Lance Cpl. Joseph Scott Pemberton on Friday morning as she saw for the first time the US Marine she had accused of murdering her transgender sister, in a case that could test the strength of security ties between the Philippines and the United States. “We locked eyes briefly but he averted his gaze. He was quiet the whole time. [He] had such an innocent face. I wanted to ask him why he killed my sister,” Marilou told reporters after emerging from the courtroom. Pemberton, charged with killing Jeffrey “Jennifer” Laude, was taken from his detention in Camp Aguinaldo in Quezon City and brought to court in Olongapo City to heed the warrant issued for his arrest. Harold Cabunoc, head of the military’s public affairs office, said a five-vehicle convoy carrying Pemberton left the camp at 2 a.m. The 19-year-old US Marine arrived at the Olongapo City Hall of Justice at 5 a.m. under heavy guard, including American armed service personnel assigned to secure him. Olongapo police blocked all doors leading to the courtroom. At least 20 officers were stationed at the doors and along corridors on the floor where the courtroom was located. Pemberton was whisked through a backdoor into the courtroom, evading dozens of journalists and cameramen waiting for him. Journalists were barred from the courtroom, but the clerk of court briefed them on the proceedings afterward. Read More …

Holidays ‘prime time’ for thieves and snatchers, US reminds nationals in PHL

Saying the holiday season is a prime time for pickpockets and thieves, the United States Embassy in Manila on Friday advised its Americans in the country to take precautions against theft, robbery, and even violent crimes. In a security message, the embassy said it has received “regular reports” of US citizens being victims of both violent crime and theft, burglary and robbery. “The Embassy wishes to remind US citizens that we are in the holiday season which is a prime time for pickpockets and thieves. US citizens in the Philippines should remain aware that while you may become a victim simply because you find yourself in the wrong place at the wrong time, foreigners may also be targeted because they are perceived to be affluent,” it said. US citizens were advised to review their personal security plans, remain aware of their surroundings including local events, and monitor local news stations for updates. They were also advised to maintain a high level of vigilance and take steps to enhance their personal security. The embassy also reminded its Americans to avoid demonstrations even if they are generally peaceful. “However, even demonstrations intended to be peaceful can turn confrontational and escalate into violence. You should avoid areas of demonstrations, and exercise caution if in the vicinity of any large gatherings, protests, or demonstrations,” it said. It also recommended carrying a means of communications at all times. US citizens in trouble can always call the Embassy at (02) 301-2000 and ask to speak to Read More …

Olongapo cops go on alert for Pemberton

US Marine Joseph Scott Pemberton. PHOTO FROM PEMBERTON FACEBOOK ACCOUNT OLONGAPO CITY, Philippines—The Olongapo City police force went on heightened alert on Thursday following reports that a US Marine accused of murdering a Filipino transgender woman would be presented to a local court on Friday. Senior Supt. Pedrito de los Reyes, city police director, said he deployed at least 100 officers around the Olongapo City Hall of Justice in preparation for the possible appearance of US Marine Pfc. Joseph Scott Pemberton at Regional Trial Court (RTC) Branch 74. The court issued a warrant on Tuesday for the arrest of Pemberton, who is accused of murdering Jeffrey “Jennifer” Laude in a motel here on the night of Oct. 11. A police officer, who asked not to be identified as he was not authorized to talk to journalists, said the city police was informed that Pemberton would be taken out of his detention at the Joint US Military Assistance Group compound in Camp Aguinaldo, headquarters of the Armed Forces of the Philippines in Quezon City, at 3:30 a.m. on Friday to be transported to Olongapo, 121 kilometers north of Manila. It was unclear how Pemberton would be taken to Olongapo, but the US government used a helicopter to transfer the Marine from his warship, the USS Peleliu, which was docked on Subic Bay, to AFP headquarters on Oct. 15. The police officer said the briefing discussed security preparations but it was not clear whether Pemberton was being taken to Olongapo for arraignment. Read More …

Pemberton can leave PHL if govt fails to gain custody over him, lawmaker warns

Lance Cpl. Joseph Scott Pemberton, the US Marine charged with murder for the killing of Filipino transgender woman Jeffrey “Jennifer” Laude, could leave the Philippines in a year’s time unless the government takes custody of him. In a statement Thursday, Bayan Muna party-list Rep. Neri Colmenares urged the Philippine government to override the US’ refusal to turn over Pemberton since it violates the country’s criminal laws and disregards the jurisdiction of the Philippine courts and law enforcement over crimes committed in the Philippines and against Filipinos. “It is unthinkable that the government should allow this brazen affront to the Filipino nation and downright revolting that the government failed to arrest and take custody of the suspected assailant Pemberton and the US authority and custody prevailed over the American suspect of killing a Filipino on Philippine soil,” he said.  Colmenares did not elaborate on how the Philippines can compel the US to turn Pemberton, who is being held in Camp Aguinaldo under guard by US military personnel, over. The US Embassy has said the US “will continue to work closely with the Philippine government to help ensure justice is served and the rights of all persons are protected.” Should the Philippines fail to get custody of Pemberton, Colmenares, a lawyer, warned that the US’ obligation to present him in court will end within a year under Article 5 Paragraph 6 of the Visiting Forces Agreement (VFA).  “This means the US can spirit him out of the country after one year. BIR slaps Makati City's cake supplier with P46.6-M tax evasion case

The Bureau of Internal Revenue on Thursday filed a P46.6 million tax evasion case against a supplier cake at the Makati City hall cafeteria and the Ospital ng Makati. Kimtun Chong, sole proprietor of Cups and Mugs Kitchenette, was accused of willful attempt to evade or defeat tax and deliberate failure to supply correct and accurate information in his annual income tax return for taxable years 2009, 2010 and 2011. Cups and Cakes is the same supplier said to have provided the supposedly overpriced cakes that the city gives senior citizens on their birthday. Whistleblowers against Vice President Jejomar Binay earlier claimed his daughter, Sen. Nancy Binay, had supplied the cakes, a claim the lawmaker denied.  Former Makati City Administrator Marjorie de Veyra earlier said the city government had been been getting the city’s cakes from their supplier Cups and Mugs since 2010. These cakes have been delivered to some 100,000 senior citizens by the staff of the Social Welfare and Development Office. An investigation by the BIR showed Cups and Mugs was engaged by Makati City to supply birthday cakes and cater food services in the Makati City Hall cafeteria and at Ospital ng Makati from 2009 to 2011. In reply to an access letter sent by the BIR, the Makati City local government certified that it paid Cups and Mugs a total of P107.64 million. “Investigators, however, discovered that despite earning a large amount income for the said years, he substantially underdeclared his correct and deliberately failed to Read More …

Ramos: PH interest is above Pemberton issue

Former Philippine President Fidel V. Ramos. AJPRESS PHOTO MANILA, Philippines – There are “higher interests” than what may be a “damaging” relationship between the country and the United States over the custody of Pfc. Joseph Scott Pemberton, tagged as suspect in the killing of Filipino transgender woman Jeffrey “Jennifer” Laude, former President Fidel V. Ramos said on Thursday. “You know on that issue, although it’s serious for all of us, must not be the cause for the damage of Philippine-US relations, because there are higher interests,” he told reporters at the sidelines of the 79th anniversary rites of the Armed Forces of the Philippines at Camp Aguinaldo. “I’m sorry for the family and I’m sorry also for the US side, but in this case, it must be our higher interests. The higher interests are Philippine interests, because we are right on site, we are on the battlefield, we are the victims of bullying by, hindi ko na sasabihin, mabuhay ang Pilipinas,” Ramos said. Ramos was obviously referring to China that is seen as a “bully” for its aggressive claims in the disputed West Philippine Sea (South China Sea). The United States has rejected the demand of the Philippines to have custody of Pemberton and to transfer him to a local jail. The Department of Foreign Affairs has expressed disappointed over the US decision. The US Marine is  currently detained at the Joint US Military Assistance Group at Camp Aguinaldo, but is secured by US personnel. Based on the Visiting Forces Agreement, the US Read More …
