WHEN the e-commerce Law was first pushed in the late 1990s, the battle cry then was that e-commerce can level the playing field for small businesses. Almost 20 years later, the bigger an organization is, the more likely it is to embrace e-commerce. However, majority in the business community still has not embrace it – from doing corporate purchases, receiving sales and making online payments to suppliers. Some people in business do not recognize that they are doing e-commerce at all. This is especially true for those who define e-commerce in a limited manner – only when there is online payment via credit card. The creation of a country’s e-commerce roadmap as being worked on by the Department of Trade and Industry (pursuing its mandate under the E-Commerce Law or Republic Act 8792) should look at e-commerce not only from its various functions in the business supply chain, but also in encouraging the adoption in various industries from government, manufacturing, retail, services, telecommunication, and many more. When looked at and embraced as a whole, we can make strides in measuring its impact in our economy – in our country’s gross domestic product, among others. Last week, I made an appeal for the creation of a national privacy commission and the release of guidelines for data privacy in government and private sector. It is also important to monitor E-Government Fund-supported projects. Dominador A. AlmiranteLabor case digest COMPLAINANTS Josephine Solano and 10 others filed a complaint for illegal dismissal, monetary claims and damages against Podden International Philippines, Inc. (Podden) and respondent Alejandro Cruz-Herrera. They engaged the services of petitioner Atty. Emmanuel D. Agustin to handle the case upon the verbal agreement that he will be paid on a contingency basis, at 10 percent of the final monetary award. The complainants, through Atty. Agustin, obtained a favorable ruling before the labor arbiter (LA). No appeal was taken from the judgment. Hence, on Feb. 2, 1999, a motion for execution was filed. The National Labor Relations Commission (NLRC), in a resolution dated May 7, 2003, ordered the labor arbiter to immediately issue the corresponding writ of execution for the enforcement of the decision, the total monetary award of which as of July 20, 1999 reached P3,358,441.84. On Aug. 6, 2004, respondent Herrera filed a petition for certiorari before the Court of Appeals (CA) assailing the resolution of the NLRC. While the petition was pending on Aug. 30, 2005, a joint compromise agreement was submitted to the CA. In a resolution dated Sept. 30, 2005, the CA approved the compromise agreement and entered judgment. Displeased, Atty. Agustin filed a petition for review on certiorari with the Supreme Court. He assailed the CA resolution, contending, among others, that the compromise agreement was unconscionable and executed without his knowledge and consent. While the Supreme Court upheld the validity of the compromise agreement, it ruled that Atty. Agustin Read More …

IT feels strange, to the point of being surreal. Here we are, barely a year out of the most damaging storm ever to hit the Philippines. And again, we are staring at the prospect of another, just as equally devastating weather disturbance, trying to retrace the steps of the one that went before it a year ago. Strange, too, to hear the name that has been chosen for this incoming weather system. While we were accustomed to hearing meteorologists talk about the “hagupit ng bagyong Yolanda over our airwaves,” I am not sure “hagupit ng bagyong Hagupit” would have quite the same ring to it. Nevertheless, poetic rhyming or not, it promises to be just as destructive as the one that went before it. We’ve all heard of the expression “like watching a train wreck in slow motion.” Oneknows it is going to come, one can see it coming, but there is very little one can do about it. Except, to get out of the way, of course. Getting out of the way, it seems, is our only option these days. As people living in a land renowned for devastating natural phenomena of every kind, it is almost inescapable that we will be subject to these furies of nature every now and again. And nature being nature, it will not care where these furies pass. Whether it be through human habitation, or remote and far-flung locations. The only problem, it seems to me, is that we are now having to Read More …
NEW BRANCH. Kenneth and Kristine Kokseng talk to reporters during the opening of Hukad in South Town Center in Tabunok, Talisay. On Wednesday, Hukad introduced five dishes, which include spicy beef flakes, oxtail humba, balot sisig, tropical brulee and ube halayan crisp a la mode. The couple said the dishes will be made available first in their Lahug branch late this month or early next year. (SUN.STAR FOTO/ALLAN DEFENSOR) HOMEGROWN Filipino restaurant Hukad of couple Kenneth and Kristine Kokseng are set for wider expansion next year as more mall establishments sprout across the country. Kenneth, in an interview on Wednesday, told reporters there are two confirmed Hukad branches to open next year, one in Iloilo and the other in Zamboanga. At present, there are 21 branches of Hukad and Golden Cowrie in Visayas and Mindanao, the newly-opened one being Hukad in South Town Center in Tabunok, Talisay. The restaurant opened four branches this year. These are in Tacloban City, Tagum City in Davao, Bacolod and Talisay City in Cebu. Golden Cowrie and Hukad bear the same menu but the former adopts a stand-alone set up while Hukad is inside commercial establishments. “We’re more on Hukad because most of the expansions are inside the malls,” Kenneth said. Of the existing branches, Christine said eight are in Cebu and all are company-owned. The 13 others are franchised. The farthest branch in the Visayas is in Boracay and General Santos in Mindanao. The couple said they are also looking forward to open Hukad in Manila, Read More …
