VFA review pushed in Senate, especially on crime

FACEBOOK PHOTO MANILA, Philippines – Two senators pushed anew on Tuesday for a review of the Visiting Forces Agreement (VFA) as they condemned the killing of a Filipino transgender allegedly by a US Marine in Olongapo City. “The VFA should be reviewed especially on the aspect of crime prevention,” Senator Vicente “Tito” Sotto III, an opposition member, said in a text message to reporters on Tuesday. “Yes, kinukendena ko. No matter who is guilty. Kawawa naman yung tao. No one deserves to die that way,” Sotto added, referring to 26-year-old victim, Jeffrey “Jennifer” Laude. Laude was killed last Saturday allegedly by the suspect identified as Private First Class Joseph Scott Pemberton. The suspect is said to be part of the US Marine Corps 2nd Battalion 9th Marines assigned at the West Pace Express. Senator Francis “Chiz” Escudero also called on the Department of Foreign Affairs (DFA) to revisit and propose amendments to the VFA. “The police and prosecutors should act fast lest the prescriptive period be breached,” Escudero said in another text message, referring to the one-year period provided for in the VFA, IN which the Philippines should complete judicial proceedings against any US personnel. “In the meantime, as before, I call on and urge the DFA to revisit and seek the amendment of the VFA regarding (its) lopsided criminal jurisdiction provision,” he said. AP FILE PHOTO MANILA, Philippines – There is no guarantee that the United States (US) will hand over custody of Private first class Joseph Scott Pemberton who is the primary suspect in the killing of a Filipino transgender in Olongapo City. Department of Foreign Affairs (DFA) spokesman Charles Jose said in a press conference Tuesday that, under the provisions of the Visiting Forces Agreement (VFA), US automatically has custody of any of their personnel suspected of committing a crime. “Under Article V, paragraph 6 of the VFA ‘The custody of any United States personnel over whom the Philippines is to exercise jurisdiction shall immediately reside with US military authorities, if they so request, from the commission of the offense until completion of all judicial proceedings’,” Jose said, citing the pertinent provision. The Philippine government will request to the US to have custody of Pemberton, a US Marine, “but there is no guarantee they will grant it,” he said. The Philippines, however, will have jurisdiction of the case and he will be tried in a Philippine court. Pemberton had allegedly killed Jeffrey “Jennifer” Laude, 26, after both checked in at a hotel in Olongapo City late Saturday night. Transgender slay an isolated case—DND spokesman

By Bong Lozada |INQUIRER.net 3:16 pm | Tuesday, October 14th, 2014 Defense department spokesman Peter Galvezgar INQUIRER.net FILE PHOTO MANILA, Philippines –The Defense Department on Tuesday said the murder of the transgender in Olongapo at the hands of a US marine was an isolated case and should not be connected to the relations between the Philippines and the US. “This is an isolated case, albeit a tragic one,” said Peter Paul Galvez, DND spokesman. “This is an unfortunate incident and the DND and the Armed Forces of the Philippines would like to extend our deepest condolences to the family and friends of Jeffrey Laude.” Galvez said the homicide and the Enhanced Defense Cooperation Agreement should be looked taken separately after the Philippine-American agreement was dragged into crime. “The exercises and the homicide are two different issues let us look at it at proper perspectives,” Galvez said. On Saturday, Laude was found dead in an Olongapo hotel with a US Marine tagged as a suspect. The American serviceman was later identified as Private First Class Joseph Scott Pemberton. American Marines and Navy personnel are in the country after participating in Phiblex, a bilateral war exercises between the US and the Philippines. Galvez also defended the exercise and Edca, saying that without the Americans, there would be no help in developing the naval capabilities of the Philippines. PH seeks custody of US Marine in transgender murder

FACEBOOK PHOTO MANILA, Philippines—The Philippines said Tuesday it will seek custody of a US Marine currently detained on a war ship under suspicion of the murder of a local transgender person as police readied murder charges against him. The body of Jeffrey Laude, also known as Jennifer, was found by hotel staff in the northern port city of Olongapo late Sunday, less than an hour after the victim checked into a room with Private First Class Joseph Scott Pemberton. Pemberton was part of the 3,500-member US contingent in the Philippines to conduct joint military exercises, which ended last week. Foreign Department spokesman Charles Jose told AFP the Philippines would seek custody of the US serviceman if he proves to be involved. He said: “I think we will and we should but there’s no guarantee (the) US will grant our request.” A police statement issued Tuesday said the US serviceman had been identified by a witness and that a murder charge was being prepared against him. The US embassy said the “suspected Marine is assigned to the 2nd Battalion, 9th Marines, out of Camp Lejeune, North Carolina.” It added that the soldier was being held onboard USS Peleliu while a joint Naval Criminal Investigative Service and Philippine National Police investigation is conducted. Australia fast-tracks visas for super rich

The visa, available from next July, builds on the Significant Investor program under which people who sink Aus$5 million into Australia are granted a minimum four-year visa. “The government will reform the program to encourage more high net-worth individuals to make Australia home,” Prime Minister Tony Abbott said in a joint statement with the immigration and trade ministers. They said the changes would “leverage and better direct additional foreign investment, while maintaining safeguards to ensure the migration program is not misused.” The reforms include a reassessment of where the investments were made so they matched the government’s “national investment priorities.” Some 436 Significant Investor visas were granted between November 24, 2012 — when the program was launched — to the end of last month, according to immigration department figures. A total of Aus$2.18 billion was invested in Australia through the program, with 88 percent of visa holders hailing from China. The government also announced a review of its 457-class skilled visa program, which was tightened under the previous Labor government amid claims of abuse by employers and disadvantage to local workers. VP Binay satisfaction rating falls to lowest since Nov 2010 – SWS

Vice President Jejomar Binay’s satisfaction rating fell to its lowest in four years, according to a new survey by pollster Social Weather Stations. The Vice President had a net rating of +52 (70 percent satisfied, 17 percent dissatisfied), down 15 points from +67 (78 percent satisfied, 11 percent dissatisfied) in the second quarter. While Binay’s rating was within the “very good” range, this was lower than the previous record low ofa “very good” +57 in November 2010. Binay has recently been linked to several controversies, including the alleged overpricing of the Makati City Hall Building II. SWS classifies net satisfaction ratings of +70 and above as “excellent”; +50 to +69 as “very good”; +30 to +49, “good”; +10 to +29, “moderate”; +9 to -9, “neutral”; -10 to -29, “poor”; -30 to -49, “bad”; -50 to -69, “very bad”; and -70 and below as “execrable.” The poll was taken from September 26 to 29, from 1,200 respondents. Sampling error margins of ±3% for national and ±6% for area percentages applied to the survey. PNoy ally: Church leaders should concentrate on their flock, not politics

Religious leaders demanding President Benigno Aquino III’s resignation should focus on strengthening the moral fiber of their flock and not on meddling in politics, an administration ally in the House of Representatives said Sunday. Cavite Rep.  Elpidio Barzaga Jr. said he sees no basis for Aquino to resign despite the controversies he is facing because his administration has been effective in implementing reforms promoting good governance. “We have the separation of the Church and State…. House Energy panel open to widening scope of PNoy’s emergency powers

The House Energy committee is ready to provide President Benigno Aquino III the emergency powers to explore all potential options to address the looming power crisis in 2015, from entering into power supply contracts to leasing generator sets (gensets) for around P6 billion. Committee chair Oriental Mindoro Rep. Reynaldo Umali said Sunday that the additional authority the House is studying to grant Aquino will allow him do the following: make the Interruptible Load Program (ILP) mandatory, contract additional capacity through bilateral means, lease or buy gensets, and implement energy conservation measures. “We don’t want to limit the President to having just one option in addressing this crisis. We want to provide him the flexibility he needs to address the power shortage next summer,” he told GMA News Online in a phone interview. Aquino has asked Congress to pass a joint resolution authorizing him, in accordance with Section 71 of the Electric Power Industry Reform Act (EPIRA), to contract additional capacity for the Luzon grid for the summer months of 2015, when a power supply deficit of at least 300 megawatts (MW) is expected. Section 71 of the EPIRA states that: “Upon determination by the President of the Philippines of an imminent shortage of the supply of electricity, Congress may authorize, through a joint resolution, the establishment of additional generating capacity.” The law prohibits the government from building power plants and entering into contracts to generate additional power supply. DOJ should keep out of Makati building probe – UNA

Why the sudden change in priorities? For the United Nationalist Alliance (UNA), Justice Secretary Leila de Lima’s sudden interest in alleged overpricing in the construction of the Makati City Hall Building II that a Senate panel is already investigating shows partisanship in government. “No one is above dilaw (yellow),” UNA interim president and Navotas Rep. Tobias “Toby” Tiangco said on Sunday, referring to the campaign color of the administration Liberal Party. He said De Lima’s credibility as Justice secretary has eroded after she expressed openness to participate in the ongoing Senate Blue Ribbon subcommittee inquiry into the Makati building despite the abundance of other controversies that need to be investigated. Tiangco said De Lima appears to be practicing a “double standard of justice” by sitting on investigations regarding the P900-million Malampaya Fund Scam, P10-billion pork barrel controversy and the alleged extortion attempt on a Czech firm for a Metro Rail Transit (MRT)-3 train contract. “We are aware that members of the Liberal Party who were recipients of the Malampaya Fund, PDAF and even DAP, are being shielded from the investigation. This only goes to show that De Lima is not keen in sending to jail allies of the President,” he said in a statement. Jeepney transport groups split on fare cut proposal

With the price of diesel below P40 per liter, a transport group has called for a fare adjustment for passenger jeepneys that will eventually lower the minimum fare to P8. “Nananawagan ako sa mga kaibigan… na magsama-sama na tayo para mabigyan natin ng pamaskong handog ang ating mga pasahero,” Pasang Masda national president Obet Martin said in a report on GMA News TV’s “Balitanghali” on Sunday. However, this suggestion was rejected by other jeepney transport groups. Jeepney drivers and operators have yet to recover from the oil price increase this year, said Liga ng Transportasyon at mga Operator sa Pilipinas (LTOP) president Lando Marquez. “Kawawa na naman itong mga tsuper na hindi nakaka-boundary dahil sa problema sa traffic, nagkakabuhul-buhol, baha kapag umuulan,” he said. “Kung meron man ‘yong nagpapapogi, siguro kailangan magkaintidihan muna, mag-unawaan muna para mapag-usapan,” he added. Other transport groups that rejected the call to make price adjustment were Alliance of Concerned Transport Organizations (ACTO) and the Federation of Jeepney Operators and Drivers Association of the Philippines (FEJODAP).
