Drilon dares PHL-US defense pact critics to bring issue to SC

Senate President Franklin Drilon on Tuesday dared critics of the new defense agreement between the Philippines and the US to question the pact before the Supreme Court (SC). In an interview, Drilon said only the high court can settle the issue on whether the newly signed defense pact–the Enhanced Defense Cooperation Agreement (EDCA)–is an executive agreement or a treaty that needs Senate concurrence. “There are various views. Marami po ang nagsasabi na ilegal kapag hinde, marami ang nagsasabi na hinde na kailangan. Sa akin po, dalhin na nila sa Korte Suprema. Whether this is a treaty or a document that would require concurrence or ratification of the Senate, or an executive agreement, that will have to be decided by the Supreme Court,” Drilon said after his speech at the UP College of Law on Tuesday afternoon. The Senate can always ask executive officials to explain the EDCA before the oversight committee on the Visiting Forces Agreement (VFA), he added. As to whether the crafting of the EDCA was transparent enough, Drilon said the executive “cannot expose positions publicly” during negotiations. On Monday, Philippine and US officials inked the EDCA, which allows for an enlarged rotational presence of American troops in the country. Senators have differing opinions on the agreement–some considering it an implementing guideline of the VFA, with others described it as a treaty. EDCA should have been tackled in Senate – Miriam Santiago

The Senate should have been consulted before the Enhanced Defense Cooperation Agreement between the US and the Philippines was signed, Senator Miriam Defensor-Santiago said in a report during GMA’s “24-Oras” program on Tuesday. “This is an unfair surprise on the Philippine Senate which, under the Constitution, shares the treaty-making power with the President,” Santiago said. She added that the EDCA would damage the country’s ailing relations with China, with whom the Philippines has a dispute with over territories in the West Philippine Sea. “Definitely the new agreement, whatever it may contain will further antagonize China,” said Santiago. Former Senator Joker Arroyo shared Santiago’s appreciation of the EDCA signing. “No one, but no one was consulted about its constitutionality or participated in its preparation. It was exclusively Malacañang directed,” Arroyo said. He added that the country gained nothing in the said agreement. “We rushed to sign the EDCA as a gift to President [Barack] Obama, signed by our Defense Secretary and the US Ambassador that would allow more American troops in the Philippines,” Arroyo said. But Foreign Secretary Albert Del Rosario disagreed and said the Philippines gained something from the agreement of both countries. Thai senators indicted over charter amendment

Associated Press 8:58 pm | Tuesday, April 29th, 2014 BANGKOK — Thailand’s state anti-corruption body has indicted 36 senators for alleged misconduct in attempting to amend the constitution to make the Senate fully elected. National Anti-Corruption Commission head Sansern Poljiak said Tuesday it found the senators had misused their authority in violation of the constitution. They will be suspended from their jobs while the Senate decides whether to impeach them. Most, however, will be replaced by recently elected senators next month. The indicted senators were among 308 current and former lawmakers charged by the anti-graft body for voting last year for a bill that would have changed the composition of the 150-member Senate, about half of which is appointed. The Constitutional Court ruled in November that the amendment to make the Senate fully elected was unconstitutional. US troops now enjoy access to PH bases

When Defense Secretary Voltaire Gazmin and United States Ambassador Philip Goldberg signed the 10-page document, it ushered in the dawn of a strengthened cooperation between the Philippines and the US. According to the document posted on Malacañang’s official website, American forces and contractors are allowed to conduct “security cooperation exercises, joint and combined training activities, humanitarian assistance and disaster relief activities,” together with Philippine forces inside the bases. Military equipment, vehicles, and aircraft from the US can also be used inside the bases during training exercises. US troops can also use Philippine bases to store their equipment vehicles and construct new buildings if both parties decide on the matter. Obama lauds 4 Navsog officers as first responders to ‘Yolanda’ crisis

AP FILE PHOTO MANILA, Philippines—Four military officers, including a Filipino from the Naval Special Operations Group (Navsog), were given special mention by US President Obama on Tuesday as the main characters in “an incredible story that captures the strength” of the longstanding alliance of the Philippines and the United States. Navsog Captain Roy Trinidad, US Col. Mike Wylie and US Majors Leo Leibreich and George Apalisok were the first responders in Tacloban City, one of the areas devastated by supertyphoon “Yolanda” (international name: Haiyan) on Nov. 8, 2013. The heavily built Trinidad caught Obama’s attention and was the reason for a few laughs with the US President as the latter mingled with the four honorees. “I told him (Obama) ‘Your guys helped me a lot.’ But he answered, ‘No, no, no. You trained them,’” Trinidad told the Philippine Daily Inquirer in an interview. Then Leibreich told the President, “He (Trinidad) whipped us into shape.” To which Obama replied, “Yeah, look at his (Trinidad’s) chest and look at his guns,” referring to the officer’s biceps, which he playfully slapped. “I didn’t feel nervous …. I was more concerned that I represent the whole AFP (Armed Forces of the Philippines) at the event. There is the pride,” said Trinidad, whose rank is equivalent to a full colonel in the Army and is a member of the Philippine Military Academy Class 1991. “But it could have been anyone else. New military accord elevates PHL-US defense alliance, says DFA Chief

A product of nearly two years of planning and negotiations, the Enhanced Defense Cooperation Agreement or EDCA was signed by Defense Secretary Voltaire Gazmin and U.S. Ambassador Philip Goldberg a few hours before the arrival of U.S. President Barack Obama, who makes his last stop in Manila today following a week-long Asian tour that includes Japan, South Korea, Malaysia and Philippines. “The EDCA elevates to a higher plane of engagement our already robust defense alliance, a cornerstone of peace and stability in the Asia-Pacific region,” Del Rosario said in a statement. “It provides new momentum for our partnership and opens up fresh avenues of bilateral cooperation,” he added. DOJ gives Cedric Lee until May 8 to answer tax evasion raps

(DOJ building) MANILA, Apr 28 (Mabuhay) – The Department of Justice on Monday gave arrested businessman Cedric Lee until May 8 to file his counter-affidavit to the P194.47-million tax evasion case filed against him by the Bureau of Internal Revenue. Lee was escorted to the DOJ early Monday afternoon by agents of the National Bureau of Investigation for the preliminary investigation of the case. Lee and his friend, Simeon “Zimmer” Raz, are detained at the NBI following their arrest in Oras, Eastern Samar on Saturday on the serious illegal detention charges filed against them and several others by television host and comedian Ferdinand “Vhong” Navarro. State prosecutor Alan Stewart Mariano said that, aside from the request of Lee’s lawyer for more time to prepare his client’s counter-affidavit, the absence of the BIR at Monday’s proceedings prompted him to allow the extension for the businessman to file his reply to the charges. Maja finally opens up about Kim

Maja Salvador (MNS Photo) Maja Salvador has finally opened up about fellow ABS-CBN contract artist Kim Chiu, with whom she recently reconciled after a year of estrangement over actor Gerald Anderson. Salvador was asked about the reconciliation on the sidelines of a photo shoot for local clothing line Petit Monde, which has renewed its endorsement contract with the actress for a fourth year. “Sobrang saya,” the 25-year-old actress said of Anderson, who is now also in good terms with Chiu, his former girlfriend. “Alam kong hindi lang sila, ako, kami, alam kong kayong lahat.” “Kasi siguro lahat iyon ang pinagdadasal, and ‘di ba, walang binibigay ‘yung Diyos… ‘Yung dasal mo, ibibigay at ibibigay niya. Carmina on seeing BB: Ang awkward talaga

Carmina Villaroel (MNS Photo) Actress-host Carmina Villaroel admitted that she felt awkward after seeing her former husband Rustom Padilla, who is now known as BB Gandanghari, during the debut party of teen star Kathryn Bernardo last month. Villaroel was Bernardo’s co-star in the hit series “Got to Believe.” Gandanghari, on the other hand, is the uncle of Daniel Padilla, Bernardo’s leading man. Villaroel said she felt “very tense” when she realized that all eyes were on her and Gandanghari when they arrived at Bernardo’s party. The actress said she is thankful that Gandanghari did not approach her that night. “Kaya siguro okay din na hindi na siya lumapit. Respect din kay Kathryn kasi parang it was her night. Darating din naman siya [sa tamang panahon]. Medyo na-tense lang ako, kasi noong dumating siya parang lahat ng tao nakatingin sa akin, sa amin.
