SC upholds life terms on 5 fratmen in Venturina slay

The Supreme Court has upheld the convictions for murder of five fraternity members in connection with the death in 1994 of Dennis Venturina, a student of the University of the Philippines and a member of a rival brotherhood. In a ruling penned by SC Associate Justice Mario Victor “Marvic” Leonen, the high tribunal affirmed the decision of the Quezon City Regional Trial Court that found five members of the Scintilla Juris Fraternity guilty for the murder of Venturina on December 8, 1994. On February 28, 2002, the trial court found suspects Robert Michael Alvir, Danilo Feliciano Jr, Christopher Soliva, Julius Victor Medalla, and Warren Zingapan guilty of murder and attempted murder, and were sentenced to the penalty of reclusion perpetua. The Court of Appeals on December 26, 2010 affirmed the guilty verdict. Court records showed Ventura and six other co-members of the Sigma Rho fraternity were eating at the Beach House Canteen near the Main Library in UP Diliman when they were attacked by masked men with baseball bats and lead pipes.  Ventura shortly afterwards died at the St. Luke’s Medical Center, while the six other victims survived. Just like the trial court and the appellate tribunal, the SC gave more weight on the victims’ positive identification of the perpetrators rather than on the latter’s respective alibis. “The victims were able to positively identify their attackers while the accused-appellants merely offered alibis and denials as their defense. The credibility of the victims was upheld by both the trial court and Read More …

Cayetano to Brillantes: ‘You're worse than Garci’

A Senate hearing on Tuesday seeking ways to prevent fraud in automated elections was marred by a verbal altercation between Senate Majority Leader Alan Peter Cayetano and Commission on Elections chairman Sixto Brillantes Jr. The heated exchange ensued after Brillantes defended himself from Cayetano’s charge that he was “Garci in disguise.”  Cayetano made the allegation in a recent plenary session after Senator Grace Poe’s privilege speech on the massive fraud in the 2004 presidential elections. Cayetano likened Brillantes to former Comelec commissioner Virgilio “Garci” Garcillano, who allegedly engineered the rigging of the elections in favor of then President Gloria Macapagal-Arroyo. “Sa konting experience ko ho na nakaupo sa Comelec, nakakabigla naman na sabihin na ako ay Garci in disguise. Hindi ko naman ho kaibigan si Garci noong 2004. Hindi ko naman kakampi si Garci,” Brillantes said during the hearing. Cayetano immediately took exception to Brillantes’ remarks, saying the Senate hearing wasn’t a venue for officials to air their gripes against senators. “Hindi po ito privilege speech at interpellation na time ni Chairman Brillantes sumagot. This is a committee hearing. Kung mayroon kaming itatanong, mamaya kapag sasagot na siya, just answer it,” Cayetano said. A visibly agitated Cayetano then told Brillantes: “To tell you frankly, in your face, you are worse than Garci… Binibilang ko po ang araw na magretire kayo.” Brillantes once served as counsel of the Tinga family, the political rival of the Cayetanos in Taguig City.  What happened to 2004 poll probe? Cayetano also criticized the Comelec chief Read More …

PH not giving up on China—Coloma

In this May 16, 2014 file photo, Vietnamese expatriates and Filipinos display placards as they join together in a rally in front of the Chinese Consulate at the financial district of Makati city to protest the recent moves by China to construct an oil rig near the Vietnamese-claimed Paracels off the contested Spratlys group of islands and shoals in the South China Sea. Policymakers in most Asian countries support a robust US role in the region even though many expect China to become the most dominant power, a survey said Thursday, June 5. AP MANILA, Philippines—Malacañang is not giving up on China. Communications Secretary Herminio Coloma Jr. on Tuesday said the Philippine government believes it will be able to patch things up with China amid territorial spats. He insisted that the Philippine navy’s friendly sports fest with Vietnamese troops in South China Sea, to which China negatively reacted to, was a demonstration of the two nations’ friendship. “This is simply a demonstration that even if these countries may have competing claims, they are able to demonstrate that the pursuit of peaceful settlement of these disputes will not stand in the way of their friendship and the people-to-people friendship that continues to flourish in spite of the differences,” Coloma said. Both the Philippines and Vietnam have been opposing moves by China to aggressively claim disputed areas in South China Sea. But the government has repeatedly explained that the territorial row does “not constitute the totality of Philippine-China relations.” “We still want Read More …

PHL to host another round of ‘goodwill games’ with Vietnam

Two days after Philippine and Vietnamese navy personnel drank beer and played volleyball together on disputed territory in the South China Sea—a display of unity that China has labeled a “farce”—the two countries are teaming up again for more “goodwill games,” with the Philippines hosting this time. “The agreement to have the Philippines as venue of the next goodwill games with Vietnam is already a commitment. And we do not intend to renege on such hosting,” Philippine Navy spokesman Col. Edgard Arevalo told reporters Tuesday. “If the end is to maintain good relations and amity with a neighboring nation; and sports is one of the means to attain it, then the Navy will have to pursue it,” Arevalo, who also heads the Navy Civil Military Operations Group, added. Arevalo also said that other nations, including China, are free to join the friendly games, which will be held early next year. “Yung ating friendly relations with other forces of other nations have already been ongoing, through subject matter exchanges, joint trainings…promoting sports is another avenue…it’s their option, they can signify intent [to join],” Arevalo said. China declines However, Arevalo added, China has already sent a signal that it has no intention of joining any friendly undertakings with other countries that have claims in the South China Sea. “This early nag-signify na sila. It looks like ayon sa kanila e ayaw nila,” Arevalo said. On Monday, China’s Foreign Ministry spokeswoman Hua Chunying described as a “clumsy farce” the friendly gathering between Philippines Read More …

Solon calls on VP Binay to quit Cabinet if he wants to attack PNoy, LP

A Liberal Party (LP) stalwart in the House of Representatives on Tuesday called on Vice President Jejomar Binay to quit from President Benigno Aquino III’s Cabinet if he wants to continue accusing LP of engineering reports linking Binay’s family to the P10-billion pork barrel scam. In a privilege speech, Caloocan City Rep. Edgar Erice said that while Binay has cleared Aquino of involvement in smear campaigns against his family, he continues to “give the go-signal” for his family and members of the opposition coalition United Nationalist Alliance (UNA) to attack the President. Alleged De Lima sex videos to be ignored in confirmation hearing

The alleged sex videos of Justice Secretary Leila de Lima will not be considered during the Cabinet offiicial’s confirmation hearing on Wednesday, Senator Aquilino Pimentel III said Tuesday. Pimentel, Commission on Appointments (CA) justice committee chairman, said in an interview that the supposed sex videos are “immaterial” to De Lima’s confirmation. “Hindi ako papatol sa tsismis, lalo na kung alleged lang yan. Alam mo, you have to authenticate, so hindi na po tayo papasok sa ganyan,” Pimentel told reporters. He added that the alleged sex videos already will not affect De Lima’s confirmation, since the Cabinet official already has the support of majority of the CA panel’s members. “The House delegation votes as a block, and most likely they will vote for the confirmation, plus one more, that makes a majority… Totoo o hindi totoo, wala na pong bearing iyan,” Pimentel said. Whistleblower Sandra Cam was earlier quoted in media reports as saying that she received four cuts of De Lima’s supposed sex videos with her driver and bodyguard. Last week, Cam attempted to block De Lima’s confirmation citing various issues involving the justice chief, including incompetence and supposed “illicit affairs.”  De Lima, however, refused to answer questions on her personal life during her confirmation hearing.    Deputy presidential spokesperson Abigail Valte earlier asked Cam not to use the CA as a venue for “whatever ax it is you have to personally grind” against De Lima. — Andreo Calonzo/RSJ, GMA News

PHL set to arrest three powerful senators

By Mynardo Macaraig Senators Jinggoy Estrada (leftmost) and Juan Ponce Enrile (rightmost) may land in jail if plunder charges, a non-bailable offense, are filed against them. The two, along with Sen. Bong Revilla, have been named by whistleblowers and alleged pork scam mastermind Janet Lim-Napoles as the lawmakers who accepted bribes for ghost projects. In photo with the senators are ousted president and now Manila Mayor Joseph Estrada (second from right) and Vice President Jejomar Binay, who is also the presumptive presidential opposition candidate in 2016. MANILA, (AFP) – The Philippines on Saturday said it was preparing to arrest three powerful senators after an anti-graft court indicted them in a massive corruption scandal that has riveted the nation. The three, who include a son of former president Joseph Estrada and a 90-year political survivor who enforced martial law under dictator Ferdinand Marcos, are accused of channeling millions of dollars of public funds into bogus organizations in return for huge kickbacks. President Benigno Aquino took office in 2010 vowing to fight the massive corruption that has long weighed down the Southeast Asian archipelago. Justice Secretary Leila de Lima, whose investigators prepared the case against the opposition senators, said she was confident they had enough evidence. “We are confident that there is enough evidence to support conviction and we continue to strengthen the evidence,” she told AFP. The evidence included testimony from whistleblowers involved in the alleged corruption and documents from government agencies showing that funds were syphoned off, she added. A Read More …
