SC seeks comment on Pemberton’s proposed transfer to Olongapo city jail

Private First Class Joseph Scott Pemberton when his mug shot was taken by Philippine National Police personnel. Pemberton is accused of murdering transgender Jennifer Laude in Olongapo, Philippines. BAGUIO CITY (Mabuhay) – The Supreme Court sought the side of Malacanang, the military, and the Department of Foreign Affairs on a petition seeking to transfer murder suspect US Marine Lance Corporal Joseph Scott Pemberton from Camp Aguinaldo in Quezon City to the Olongapo City Jail. The SC, in an en banc summer session here, ordered respondents in the petition filed by Laude’s sisters to submit a comment “within 10 days from notice on the petition for certiorari.” Apart from Executive Secretary Paquito Ochoa, AFP chief Gregorio Pio Catapang Jr., and Foreign Affairs Secretary Albert del Rosario, also named respondents in the petition were Judge Roline Jinez-Jabalde of the Olongapo Regional Trial Court Branch 74, Pemberton, and Olongapo City Chief State Prosecutor Emilie delos Santos. In their petition, Marilou and Mesehilda Laude asked the high tribunal to reverse two orders from Judge Jabalde denying their request to transfer Pemberton from an American military facility inside Camp Aguinaldo, to a city jail. The petitioners said Jabalde committed grave abuse of discretion when, on technicaliries, she dismissed a request to compel the Armed Forces of the Philippines to surrender custody of Pemberton the Olongapo City Jail. They also said that under the Visiting Forces Agreement (VFA), the Philippines should have primary jurisdiction over Pemberton while his case is being tried by a Philippine court. Read More …

When bullied, call Uncle Sam

President Benigno S. Aquino and the Armed Forces of the Philippines (AFP should take a more assertive action to defend our country’s sovereignty in the ongoing feud between the Philippines and China over the disputed islands in the South China Sea. China has recently stepped up its actions to press its maritime claims by sending more military vessels within the disputed areas. President Aquino, on the other hand, apparently is doing the opposite. Aside from doing nothing in terms of negotiation with China, he ordered all Philippine navy vessels in the disputed areas to pull back on the pretext  that the ships were threatened constantly by typhoons. It is known to all our neighboring Asian countries that we are not capable of defending the disputed areas in the South China Sea. Most of our weapons are outmoded and our military aircraft and vessels donated by the United States, are either obsolete or second-hand. In 2012, a bloody confrontation between the Philippine Coast Guard  and Chinese coast guard almost erupted. Our coast guard tried to apprehend Chinese poachers in the Scarborough Shoal, about 124 nautical miles from Manila. They however were prevented by heavily armed Chinese Coast Guard from arresting the poachers. It must have been hard for our maritime security sailors to “turn their cheek the other way” to avoid bloodshed knowing that they were both outgunned and outmanned. Knights of Rizal-HFT Chapter, Pilipino Women’s Club of LA , the District 13 Office of Council Member Mitch O” Farrell and the Philippine Consulate General of Los Angeles (PCG-LA) The last  meeting of the organizing group was held at the Office of District 13 last April 16, 2015  and was presided by Angelo Yenko of the District 13 office. DFA grants family’s request to visit Mary Jane Veloso in Indonesia

Indonesia’s Supreme Court upheld its ruling and ordered her execution.(MNS Photo) MANILA (Mabuhay) – The Department of Foreign Affairs (DFA) has granted the request of the family of Mary Jane Veloso, the Filipina facing execution in Indonesia for drug smuggling, to visit her there. “At the initiative of Foreign Affairs Secretary Albert F. del Rosario, arrangements have been made by the Department of Foreign Affairs to accommodate the request of Mary Jane Veloso for her family to visit her in Indonesia,” the DFA said in a brief news release Wednesday. “Any delay in their trip is brought about by personal engagements of the family,” it added. Veloso’s father Ceasar, accompanied by lawyers, left for Indonesia on Tuesday to appeal for her freedom. It was his third time to meet his daughter since her arrest and incarceration in 2010. Prior to that, on April 17, Veloso’s sister Marites went to Indonesia bearing a notebook containing messages from their parents and Veloso’s children. President Benigno Aquino III earlier this week sought for Veloso’s clemency before the Indonesian government – his third attempt to save the Filipino convict’s life. Chiz to announce 2016 plans in October

Senator Chiz Escudero, chair of the Senate Finance Committee, delivers a privilege speech on the 2014 General Appropriations Bill, Tuesday morning. According to Escudero, the 2014 budget proposal, which includes funds for climate change adaptation and disaster risk reduction programs and projects in the amount of P70 billion, will also include specific funding for the rehabilitation of the Visayas on top of the existing calamity fund to be sourced from items which can be postponed in the 2014 national budget. During a weekly forum at the Senate on Wednesday, Escudero said he will most likely announce his decision at the last day of the filing of certificate of candidacy in October. Asked if money is among the factors he is considering, Escudero said, “Syempre kasama na yun lalo na sa isang kandidato na tulad ko na mula’t mula palaging kulang at salat ang pondo,” “Hindi naman ganun kadali ang magdesisyon dahil apektado ang buhay mo at mahal sa buhay mo. Ex-poll chief urges Comelec not to appeal SC ruling on PCOS repair deal

(MNS photo) MANILA (Mabuhay) – Instead of appealing the decision of the Supreme Court, former elections chairman Sixto Brillantes Jr. on Wednesday urged the poll body to look for another company that will repair the 81,000 Precinct Count Optical Scan (PCOS) machines that will be used in the 2016 polls. “I think the commission now should look for an alternative immediately instead of filing a motion for reconsideration,” Brillantes said. The SC on Tuesday voided the P300-million diagnostics and repair agreement between the Commission on Elections and Smartmatic-TIM, after it was questioned by the Automated Elections System and the Integrated Bar of the Philippines. In voiding the contract, the Supreme Court noted that the Comelec “failed to justify its resort to direct contracting,” according to court spokesman Theodore Te.
