Senator pushes for amendment of BBL preamble to protect minority

The Senate Committee on Local Government, chaired by Senator Bongbong Marcos, together with the Committees on Peace Unification and Reconcillation; and Constitutional Amendments and Revision of Codes, will contiunue its inquiry on the proposed Bangsamoro Basic Law. Also present during the BBL hearing is Senator Chiz Escudero. (MNS photo) MANILA (Mabuhay) – Senator Teofisto Guingona III on Wednesday called for revisions in the preamble of the proposed Bangsamoro Basic Law to ensure the protection of minority communities living in areas covered by the planned autonomous region. Guingona said there is a need to ensure the consistency of BBL provisions with the Constitution amend part of the preamble which currently refers to the aspiration of “the Bangsamoro People.” He said this should instead read as “the inhabitants of the Bangsamoro,” a phrase which ensures “inclusiveness” and the “clear and unequivocal protection of the rights of non-muslim Filipinos” in that region. “There are communities of indigenous and non-Muslim peoples in the areas proposed under the Bangsamoro,” he pointed out. “The BBL in its final form must ensure that they are treated equally and that their right to life, liberty and property are respected even if they are a minority,” he said in a press statement. He said this is also the reason why he is proposing the deletion of the third paragraph of the Preamble of the draft BBL which proclaimed the concept of “self-determination.” He believes such word has been “misused” since what is guaranteed by the Constitution is territorial autonomy Read More …

Bongbong suggests backchanneling to defuse tension in WPS

The Senate Committee on Local Government, chaired by Senator Bongbong Marcos, together with the Committees on Peace Unification and Reconcillation; and Constitutional Amendments and Revision of Codes, will contiunue its inquiry on the proposed Bangsamoro Basic Law. Also present during the BBL hearing is Senator Chiz Escudero. (MNS photo) MANILA (Mabuhay) – Senator Ferdinand Marcos, Jr. on Wednesday urged the Aquino government to explore backchannel diplomacy to defuse the tension between the Philippines and China over the West Philippine Sea. In a press statement, Marcos said the government could tap Filipino businessmen to reach out to their colleagues in China and help in asking the Chinese government to stop its aggressive position on the disputed territories. “Diplomacy is not exclusively a government to government endeavor. There are a lot of Filipino businessmen with businesses in China and they have friends and connections there. Let’s utilize that, ask them to talk to their friends on how we can resolve this matter peacefully,” he said. He added the thrust of such backchanneling is to persuade China to stop its massive reclamation and aggressive stance in the disputed territories to give way for a dialogue to resolve the conflict. “Even if we don’t manage to arrive at an agreement immediately, if we are talking, there’s a chance we might be able to reason with China to stop doing what it’s doing and continue talking. If we manage to do that, there is hope for a peaceful resolution,” the senator said. In 2012, Senator Read More …

OPAPP’s stubbornness on BBL delayed deliberation – Escudero

The Senate Committee on Local Government, chaired by Senator Bongbong Marcos, together with the Committees on Peace Unification and Reconcillation; and Constitutional Amendments and Revision of Codes, will contiunue its inquiry on the proposed Bangsamoro Basic Law. Also present during the BBL hearing is Senator Chiz Escudero. (MNS photo) MANILA (Mabuhay) — The passage of the proposed Bangsamoro Basic Law would have been easier and faster if the government peace panel has been open to the amendments and admitted its shortcomings earlier on, Senator Francis Escudero said Monday. During the Senate hearing on BBL, Escudero scored the Office of the Presidential Adviser on the Peace Process (OPAPP) and the peace panel for failure to consult all the stakeholders in the Bangsamoro. “Sa totoo lang kung sa simula’t mula naging bukas ang OPAPP at GRP sa mga  pagbabago, mas mabilis pa siguro maipapasa ito. Kayo po, iyong mga bossing niyo sa OPAPP at GRP ang nagmatigas e.  Ang posisyon as is where is, hanggang noong isang linggo. Umamin lang sila noong isang gabi sa Malacanang na sige baguhin na natin,” he said. OPAPP Undersecretary Jose Lorena admitted during the hearing that the consultation they conducted was not enough. “There is an understanding that there will be consultation when Congress discusses this (BBL). The Congress will draft a law that will reflect the sentiment of the people and not just the MILF (Moro Islamic Liberation Front),” he said. Escudero then asked why the OPAPP was stubborn on its position that the BBL Read More …

When you can’t pay your business debts!

If your business is in distress – you owe a lot of money but you can’t pay, your creditors will probably threaten legal action against your business and very likely, you personally as well. How much they can collect, and how they can go about collecting it, will depend on how your business is organized, and whether you personally guaranteed repayment of the obligation. To what extent you are personally liable depends on several factors, the most important being, how your business is structured and whether you personally guaranteed or secured the debt. Sole Proprietors and Partnerships If you are a sole proprietor, you and your business are one and the same in the eyes of the law, which means you are personally responsible for all of the business’s debts. If there isn’t enough money in the business to pay these debts, creditors can take your personal assets to pay them. Partners in a general partnership have similar personal liability for business debts: Each partner is personally liable for the entirety of the business’s debts (and any partner can usually bind the entire partnership to a business deal — a scary combination). This means that if there isn’t enough money in the business to pay the debts, and your partners are broke, creditors can take your personal assets to pay all of the business’s debts, not just your share. Corporations and Limited Liability Companies If your business is organized as a corporation or a limited liability company (LLC), your personal Read More …

Senate to probe suspicious P2B Philhealth claims

Philhealth says its 600 members nationwide may stop honoring Philhealth benefits because of the delayed release of reimbursements for services rendered but assures that all regional offices have made a commitment to pay claims of all providers faster than the 60 days processing time as mandated by law. Photo: Russell Delvo/Gensan Info Office MANILA (Mabuhay) – The Senate is set to investigate the alleged anomalous and fraudulent claims by accredited hospitals and clinics to the Philippine Health Insurance Corporation (PhilHealth) amounting to P2 billion. Senator Teofisto Guingona III, chairman of the blue ribbon committee, said he heard of disturbing claims that some accredited hospitals and clinics would seek out large volume of PhilHealth members to operate on even if the treatment is unnecessary and may even be dangerous to the patient. “If found true, this is a matter of national concern. It is criminal to misappropriate funds that are actually needed by other patients. But to endanger the lives of Filipinos as a means to eat through PhilHealth’s funds is beyond deplorable,” he said Tuesday. PhilHealth officials earlier raised red flags on some benefit payments to accredited hospitals and clinics around the country amounting to P2 billion, including P325 million worth of ‘highly suspicious’ benefit payments to two eye care centers in Metro Manila. The Department of Health stated that an investigation was prompted after an audit of the year 2014 showed that Read More …
