US Marine: PHL has no case

Pemberton asks court to dismiss criminal charges AFP chief Gen. Gregorio Pio Catapang Jr. (left) and US Marine officials inspect the 20-ft. shipping container which was converted into a temporary detention cell for USMC Private First Class Joseph Scott Pemberton, suspect in the killing of Filipino transgender woman Jeffrey Laude, in Camp Aguinaldo on Wednesday, October 22. (MNS photo) Manila, Philippines  – A US Marine facing trial for the murder of a Filipina transgender woman urged the Philippine Department of Justice on Monday to dismiss the case against him. In a petition filed with the department, the lawyer for Private First Class Joseph Pemberton argued that prosecutors did not present enough evidence to charge him with the killing of Jennifer Laude. The body of Laude 26, also known as Jeffrey, was found at a cheap hotel in the red light district of the northern port of Olongapo in October after she checked in with Pemberton, police in that city said. But the petition argued that the evidence linking Pemberton to the killing was “based on nothing but conjectures and speculations”. “There was no evidence presented as to the details of the purported assault during the preliminary investigation other than the surmises and conjectures of the supposed witnesses and the baseless conclusions of the (Olongapo) police,” the petition argued. The murder case against Pemberton was filed with an Olongapo court which issued a formal arrest warrant for him last week. However a petition to the justice department is also an option Read More …

Who has legal authority on US Marine?

The bigger issue regarding the murder trial of U.S. Marine Joseph Pemberton which needs to be resolved without damaging the American-Philippine relations is who has the legal authority over the murder suspect. Both the United States and the Philippines are claiming that their government has the right to claim legal custody of a U.S. military personnel under criminal investigation or indictment as stated in the Visiting Forces Agreement (VFA) in 1998. If we are going to base it on a Philippine Supreme Court ruling handed down in 2009 involving another American military personnel accused of raping a Filipino woman also in Subic City, then it is the Philippine government which has legal custody of any American soldier accused of a crime if committed within Philippine jurisdiction. The United States is seeing it differently based on their own interpretation of the 1998 VFA. It is the hope of everybody that both U.S. and Philippine government officials will be able to negotiate amicably the “custody issue” without damaging the cordial relationships nurtured through the years by both countries. I hope too that they will resolve this sensitive issue before it becomes a full blown “tug-of-war” between both countries. No less than President Aquino in a statement said that the case should not “sour” the country’s relations with the United States – the Philippine’s most important diplomatic and military ally. Because of what seems to be an unabated Chinese aggression in a long-running territorial dispute with the Philippines in the South China Sea, Read More …

Fil-Am from Cavite is California Teacher of the Year

By Nimfa U. Rueda Lovelyn Marquez-Prueher awarded as California Teacher of the Year LOS ANGELES – When Filipino-American Lovelyn Marquez-Prueher was a young immigrant student struggling to learn English, her teacher thought she had a learning disability. She also got bullied by classmates because of her foreign accent. “Those challenges have made me a strong advocate for immigrant students who are English learners,” said Marquez-Prueher, the first Filipina to become a California Teacher of the Year. A 34-year-old English teacher at Dodson Middle School in the Los Angeles Unified School District, Marquez-Prueher has recently been selected as one of the top five among the nearly 300,000 public school teachers in the state. As a California Teacher of the Year, she serves as a standard-bearer for the teaching profession statewide. “This is not just an award but an opportunity to talk to students, parents and fellow teachers all over California about what it’s like to be an immigrant…and to be suspected of having a learning disability because of language needs,” she said. “This is about overcoming obstacles by working really hard and not settling for being average.” Cultural gap Marquez-Prueher, whose family is from Cavite, came to the United States when she was nine years old. As a newcomer, she had a tough time in the classroom, having to overcome not just the language barrier but also the cultural gap. When she was in third grade, her teacher asked which in the group didn’t belong in a drawing of a spoon, fork, knife Read More …

Thrill of a lifetime: Soaring high above LA for the holidays

This writer’s family had the thrill of our lifetime when my sister, Marjorie D’Angelo pretended to invite my son, granddaughter and I to a “holiday dinner” to celebrate a “milestone” and the Filipino tradition of  “simbang gabi” (evening Mass heralding 9 days before Christmas) this week. Though it was a rainy day, the skies cleared up by sunset and through Margie’s relentless coordination with a gentleman named Roscoe Gray, the evening became an eventful “thrill of a lifetime” when we arrived at the Van Nuys Airport hangar of Elite Helicopter Tours, owned by Pilot/Entrepreneur Simon Davis. Born and raised in Vancouver, Canada, Simon Davis was formerly a professional snowboarder who has travleled via helicopters through the backcoutries of Canada, Alaska and New Zealand.  Davis has long been intrigued by these helicopter rides and one day, when he was offered a free ride along with two of his buddies, he somehow developed a “bug” or an addiction to flying. This prompted him to enroll in flight school and was trained for a year. Subsequently he moved to California and settled in Malibu. What started as a hobby for him made him pursue his passion for flying by working as a flight instructor, but in 2006, when he received his FAA license, he bought his first helicopter, a Robinson R44 for personal use, but he discovered not only the business side of it but also a way to connect with people’s emotional side, by way of seeing their “smiles” when they “soar above LA” and tour its wondrous sights. The 45-minute Read More …

The tradition of Simbang Gabi has endured for more than 400 years. The nine-day pre-dawn celebration of the Mass serves as a prelude to the climatic celebration of Christmas. Lawmaker wants tax exemption for Pinoy boxers

Reports said that Manny Pacquiao’s adviser Michael Koncz (third from right) was responsible for his tax woes. The BIR has made it clear that if only Pacquiao could show that he paid his US taxes, he won’t be “double taxed” by the Philippine government. Photo: Chris Farina / Top Rank MANILA (Mabuhay) – A lawmaker is seeking to exempt Filipino boxers from paying tax out of the prize and other monetary benefits they receive from boxing competitions. Representative Emil L. Ong of the Second District of Northern Samar said his proposal, embodied in House Bill 5234 or the proposed “Filipino Boxers’ Benefits and Protection Act of 2014,” aims to support Filipino boxers who brought honor to the country despite risks to their lives. “The proposal is in line with the constitutional provision pertaining to the promotion of sports, and aims to enable Filipino boxers to enjoy their winnings by making those (winnings) tax-exempt,” said Ong in a statement. “The tax exemption is an incentive that must be given and enjoyed by our boxers, just like American boxers,” he added. Ong noted that boxers earn their income on a per-fight basis. “As distinguished from other tax payers, Filipino boxers only enjoy the prize of their winnings for a limited period of time,” he explained. “Hence, the remainder of their income from winnings after taxes is what is left for a lifetime of support for the boxer and his family.” Ong further explained that hosting a boxing event provides economic benefits to Read More …

Death penalty: Let people decide – Sotto

Senator Vicente C. Sotto III (photo courtesy of www.senate.gov.ph) MANILA (Mabuhay) – Senator Vicente “Tito” Sotto said he would withdraw his proposal to revive the death penalty in the country if majority of Filipinos would say that they are against it. Aside from his bill pending in the Senate seeking the reimposition of the death penalty for heinous crimes, Sotto  said he would file in January next year another measure seeking capital punishment for high-profile drug traffickers. The senator said he was confident that his proposals would pass the Senate. Told that various sectors were strongly opposing his proposal, Sotto said: “Ah hindi, mas maraming in favor. I challenge them to conduct a survey. Let the people decide.” (Oh, no. More people are in favor.) He added that he was confident that his bills would be approved despite him being in the opposition. “Kasi mararamdan nila ito ang gusto ng taumbayan,” Sotto explained. (They [other senators] feel that this is what the people want.) But he added that should a survey be done and majority of Filipinos oppose the death penalty, he would withdraw his proposals. “Kung majority sasabihing ‘Huwag,’ I’ll withdraw,” the lawmaker said. (If majority would say ‘No,’ I’ll withdraw.) “Tandaan nila vox populi, vox dei.” (They [opposition] should remember that the voice of the people is the voice of God.) The senator said he was ready to present his arguments on why there was a need to reimpose capital punishment in the country. Responding to claims that Read More …
